Preservation Period and Destruction of the closed File

The files of the closed cases are divided into two categories: files of patent applications that are closed without being granted a patent right (having been withdrawn, having been deemed to have been withdrawn and the right has not been restored, or having been rejected and the request for reexamination has not been filed, or not having been initiated administrative litigation against the reexamination decision, or having gone through the formalities for dissolution of appointment of the patent agency) and files of patent applications that are closed after being granted a patent right (patent right having been abandoned, termination of the patent right due to nonpayment of the annual fee, expiration of the patent right, having gone through the formalities for dissolution of appointment of the patent agency, patent right to be announced completely invalidated, etc.).

The preservation period for the closed files is five years, from the closing date of the relevant procedure.

 

The preservation period for the files of the original application with divisional applications shall start from the last closing date of the divisional applications.

 

Before destruction, a list of destructed files shall be checked and approved.
