Mr. Jia obtained a master’s degree in Communication Engineering from Beijing Institute of Technology in 2008. Mr. Jia started his work in IP law in 2010, joined Liu, Shen & Associates in 2012, and qualified as patent attorney and attorney at law. Mr. Jia specializes in patent prosecution, reexamination, patent invalidation, IP litigation, and client counselling with a focus on commercial patents (NSEP) and communication Standard Essential Patents (SEP).
Before starting his work in the practice of IP law, Mr. Jia worked as a software engineer in a communication company for two years.
Mr. Jia has been designated to study for NGB corporation, Japan for 3 months in 2019, and trained the attorneys in NGB on some issues related to prosecution, invalidation and litigation of Chinese patent practice.
Mr. Jia is richly experienced in patent invalidation and litigation, and has represented a number of domestic and foreign giant companies in patent licensing negotiations and related disputes, invalidation, and infringement litigation with other domestic and foreign giant companies.
Mr. Jia has led and deeply participated in several patent relevance assessment projects and patent validity assessment projects, some of which involving SEP, and some involving NSEP. In these projects, Mr. Jia has analyzed dozens of NSEPs to evaluate the relevance degree of patents and targeted products, analyzed more than one hundred of SEPs to evaluate relevance degree of patents and communication standards, and analyzed validity of dozens of patents against prior arts.
Mr. Jia Hongbo is familiar with China's telecommunication industry standards and 3GPP international standards. He has been committed to the analysis and evaluation of essential patents for 3GPP standards for many years. He leads the evaluation team to continuously analyze the patent declarations of each company in ETSI, and leads the team to analyze declared patents and corresponding standards, evaluate the real number and proportion of standard essential patents actually owned by major companies.
Representative cases:
- 2020-2023, in several patent licensing negotiations and related disputes between a foreign giant company and certain giant domestic and foreign giant companies for each time, leading the team representing the foreign giant company to process patent selection and analysis, patent litigation strategy analysis, patent licensing fee and FRAND issues analysis, etc.;
- 2016-2019, in a series of patent infringement and invalidation cases between Samsung Electronics V. Huawei, representing Samsung Electronics to attend SEP and non-SEP patent infringement group cases as a core member of the team. The issues involved include the infringement logic for SEP related cases, calculation of SEP royalties, determination of FRAND, and determination of injunctions for SEP and non-SEP cases;
- In the case of a dispute between a foreign giant company and another foreign giant company, representing the foreign giant company in patent screening and analysis, litigation strategy analysis, participation in litigation and invalidation proceedings, etc.;
- Samsung Electronics v. Dunjun, in the patent invalidation case, representing Samsung Electronics as the invalidation petitioner, all patent rights were declared to be invalidated in court during the oral hearing;
- Samsung Electronics v. Netac, in the patent invalidation case, representing Samsung Electronics as the invalidation petitioner, all patent rights were declared to be invalidated, and the patentee did not file administrative lawsuit.

Ms. Yujie Jin joined Liu, Shen & Associates in 2005 and obtained the qualification as a patent attorney in 2006. Ms. Jin's practice mainly focuses on patent prosecution and enforcement, including patent application, patent invalidation and patent litigation in the technical fields of electronic engineering, communication technology, computer science, semiconductor technology, automatic control, image processing, video and audio codec, Artificial Intelligence, Internet and E-commerce, etc.
Ms. Jin handles a large number of cases related to patent application and examination as well as patent reexamination every year since 2006, and is skilled in dealing with difficult and complex problems in patent prosecution. Ms. Jin also has rich experience in patent relevance and stability evaluation, has engaged in a large number of commercial patent vs. targeted product analyses, communication standard essential patent vs. standards analyses, and stability analyses for both commercial patents and SEPs.

Ms. Shan JIAO is a Partner at Liu, Shen & Associates. She holds a dual degree of LLB & Bachelor of Economics from Peking University (Beijing, China) and a Juris Doctor degree from Columbia Law School (New York, United States). She specializes in antitrust and competition law, SEP-related consultancy and dispute resolution. Her experience covers multiple industries including communication, semi-conductor, Internet, automobile and shipping.
Ms. Jiao has over ten-year experience in SEP-related legal services and gained diverse experience in providing one-stop solution for SEP related licensing, transaction, compliance, administrative proceeding, infringement actions, FRAND actions, ASI and antitrust investigation and litigation. She handled over forty relevant cases and projects, including Samsung v. Huawei, Xiaomi v. InternDigital and Samsung v. Ericsson. Representative cases:
- Samsung v. Ericsson - SEP rate setting litigation, Anti-suit Injunction (ASI) and Anti-anti-suit Injunction (AASI). Ms. Jiao represented Samsung who filed a global rate-setting lawsuit before Wuhan Intermediate Court against Ericsson. Ms. Jiao successfully assisted Samsung to secure a global ASI and AASI order issued by Wuhan Court.
- Huawei v. Samsung - a series case of patent infringement, invalidation and FRAND rate-setting case (between 2016 and 2019). This high-profile case involves dozens of SEP disputes before Beijing Intellectual Property Court, Shenzhen Intermediate Court and others. Ms. Jiao represented Samsung to establish FRAND defense for SEP injunction, royalty theory and expert witnesses testimony.
- Xiaomi v. InterDigital - SEP rate setting litigation and Anti-suit Injunction (ASI) . Ms. Jiao represented Xiaomi and sercured an ASI order issued by Wuhan Intermediate Court against Ericsson. This is the first worldwide ASI order ever issued by Chinese courts.
- National Development and Reform Commission’s antitrust investigation into Qualcomm. As counsel and interpreter for NDRC, Ms. Jiao assisted with on-site investigations and all the important meetings. She participated throughout the entire investigation and provided legal advice.
- Panjin Dongxing v. Petro China and its subsidiary - Abuse of Market Dominance Action. Panjin Dongxing was a local supplier who sued Petro China and its subsidiary for abuse of market dominance. Ms. Jiao represented Petro China and its subsidiary in this case before Beijing IP Court. The Court accepted nearly all of our arguments and dismissed all of plaintiff’s claims. This case is selected as “Top 10 Typical Antitrust and Competition Cases Since 2014” by Beijing IP Court.
- Greatview Packaging v. Tetra Pak, Xinjufeng Packaging v. Tetra Pak - Abuse of Market Dominance Action. Ms. Jiao represented Tetra Pak in these follow-on civil actions filed by two competitors after Tetra Pak was fined by Chinese competition authority for abusing market dominance. The cases concerned important legal and economic issued and were heard by Beijing High Court.
- Mlily v. TDI Suppliers - Price Fixing Action. This is the first civil action against price fixing through tacit collusion. Ms. Jiao represented one of the four co-defendants. The case was first heard by Ningbo Intermediate Court and appealed to the Supreme People’s Court.
- Maersk Line’s Acquisition of Hamburg Süd. Ms. Jiao assisted Maersk Line with merger filing to China competition authority and remedy implementation after the transaction was approved conditionally. The case was selected as one of the twelve merger filings in the book titled 12 Years of China Antitrust Law.
- NDRC investigation into the containerized shipping industry. NDRC investigated into containerized shipping companies for charging THC. Ms. Jiao assisted with Maersk Line in responding to the investigation. The case was eventually suspended without fine.
- NDRC antitrust investigation into the roll-roll industry. The NDRC investigated the price-fixing behaviour of companies in the roll-on-roll-off business. Ms. Jiao represented Compañia Maritima Chilena S.A. and obtained a very favourable result for our client.
