In early 2025, the Xinhua Net App, in collaboration with the Capital Intellectual Property Services Association, launched a call for the "2024 Exemplary Cases of IP Protection for Chinese and Foreign Enterprises." Following an extensive collection process, professional evaluations, and stringent screening, three intellectual property cases represented by Liu Shen & Associates distinguished themselves among numerous outstanding entries. Their successful inclusion, attributed to their professional excellence and landmark significance, underscores the firm’s preeminent strength and industry influence in the intellectual property sector.

Exemplary Cases

  • Pre-litigation Act Preservation Dispute between Roborock Technology Co., Ltd. and Dreame Innovative Technology (Suzhou) Co., Ltd.

This case not only demonstrates the stringent review standards for pre-litigation act preservation applications in the intellectual property field but also highlights the effectiveness of the new reconsideration mechanism for act preservation in providing judicial relief, serving as a reference paradigm for future similar cases. Furthermore, it serves as a reminder to enterprises to exercise prudence when applying for act preservation and to ensure comprehensive evidentiary preparation to effectively safeguard their legitimate rights and interests.

  • Unfair Competition Dispute Concerning the Protection of Shop Decoration for a Catering Company

As an intellectual property dispute involving multiple related litigations, this case demonstrates multifaceted innovative value in the field of IP protection. This was achieved through the precise definition of legal application, the breakthrough design of defense strategies, and the systematic refinement of adjudication standards, all of which contributed to the successful resolution of the matter.

  • "Real vs. Fake" Special Metals Corporation (SMC) Dispute

Through an integrated enforcement strategy combining administrative and civil actions, alongside in-depth online and offline investigations across China and the United States, Liu Shen successfully safeguarded the client's rights and interests. This comprehensive approach effectively eliminated any potential future infringement or unfair competition by the opposing party.

 

A total of 41 cases were selected for this call, encompassing intellectual property service agencies as well as Chinese and foreign enterprises. The scope of the cases covers diverse areas, including exemplary services, operations management, dispute resolution, information services, risk management, technological integration and innovation, administrative protection, international experience, education and dissemination, cooperative alliances, and socio-economic impact.

With the support of the China National Intellectual Property Administration (CNIPA), the Beijing Municipal Intellectual Property Office, and the Capital Intellectual Property Services Association, a panel of renowned industry experts and scholars evaluated the entries. With the goal of providing high-quality references for the industry, the evaluation focused on the authenticity, representativeness, influence, innovativeness, and timeliness of each case, aiming to select typical IP cases with significant demonstration and leadership value.

The promotion of these benchmark cases not only provides the industry with replicable and scalable practical experience but also effectively enhances public awareness of intellectual property protection, comprehensively promoting the high-quality development of the IP protection cause.
