Liu Shen Partner ZHANG Xiang Invited to Attend 2024 China Intellectual Property and Innovation Summit

The Beijing stop of the 2024 China Intellectual Property and Innovation Summit (CIPIS) concluded successfully in Beijing on November 22. Hosted by Conways, the summit drew participation from hundreds of in-house IP executives and received strong backing from over ten renowned domestic and international law firms including Liu Shen.

Renowned experts and scholars delivered in-depth insightful presentations covering trademarks, patents, SEPs, IP management, trade secrets, artificial intelligence, pharmaceutical IP and other key themes, fostering robust exchanges across the intellectual property industry.

Liu Shen Partner ZHANG Xiang was invited to attend the event and delivered a keynote speech entitled New Trends in Judicial Protection of Corporate Trade Secrets. His speech was structured into three core sections. In the first part, Mr. Zhang presented judicial big data analysis on trade secret-related cases, sorting out adjudication practices of operational secret and technical secret disputes over the past decade, enabling attendees to gain a clear overview of prevailing win rates, compensation standards and core determinants of case outcomes in such litigations. In the second part, he reviewed the evolution of laws and regulations governing trade secrets, with particular focus on the progressive judicial interpretations and legislative adjustments concerning confidentiality measures — an essential constituent element for trade secret identification. From an international perspective, he also elaborated on relevant trade secret provisions under the TRIPS Agreement, the China-US Phase One Economic and Trade Agreement, and the 2022 US Intellectual Property Protection Act. In the third part, combining his rich litigation experience and typical precedents, he shared professional insights from multiple dimensions including ownership confirmation, essential constitutive elements of trade secrets, infringement verification criteria, civil liability imposition, and criminal-civil law intersection issues. He also put forward practical strategies for effective trade secret enforcement and defensive response, which was well-received by all present participants.
