Ms. YUE Xuelan was invited as a panel speaker at the roundtable entitled Proactive Protection: Rapid Response to Trade Secret Threats. Based on simulated practical scenarios, she engaged in in-depth discussions with in-house legal executives from the semiconductor, biopharmaceutical and internet industries, focusing on emergency response procedures after trade secret leakage, major causes of such incidents and core challenges facing current trade secret protection practices.

Drawing on rich hands-on experience, she shared unique insights on evidence collection and preservation upon discovery of trade secret infringements, available legal remedies, and cross-department emergency coordination mechanisms within enterprises. She pointed out that most trade secret breaches stem from insufficient staff awareness of confidentiality obligations, which has become even more prominent amid the widespread adoption of AI tools. She suggested enterprises formulate clear and enforceable confidentiality rules, clarify the scope of confidential information and roll out systematic staff training programs accordingly. Furthermore, enterprises are advised to adopt a diversified protection strategy instead of solely relying on trade secret protection. By integrating patents, contractual clauses and institutional governance, companies can establish a comprehensive and multi-dimensional IP protection system to safeguard core technologies and confidential information in an all-round manner.
