Liu Shen Supports Successful Launch of Shenzhen’s First Data Intellectual Property Service Trusts

Under the guidance of the Shenzhen Municipal Administration for Market Regulation (Shenzhen Intellectual Property Administration) and the Shenzhen Regulatory Bureau of the State Administration of Financial Regulation, and with the assistance of the Shenzhen Institute of Standards and Technology, Shenzhen’s designated registration authority for data intellectual property, China Resources SZITIC Trust Co., Ltd. (CR Trust) successfully launched the first batch of data intellectual property service trusts in Shenzhen on August 22.

As Shenzhen’s inaugural batch of data intellectual property service trusts with IP licensing rights as trust assets, these landmark projects mark a new breakthrough in the development of the Shenzhen Model for data IP service trusts. Leveraging financial innovation, the initiative unlocks the value of intellectual property and data assets, and facilitates the commercialization and transformation of scientific and technological achievements.

Joining hands with three enterprises, namely Artron Culture (Group) Co., Ltd., Shenzhen Longhua Drainage Co., Ltd., and Chengcheng Zhishu Technology (Shenzhen) Co., Ltd., CR Trust launched three data IP service trust projects via the trust mechanism. Spanning the sectors of cultural heritage preservation, urban governance and agricultural technology, the projects inject robust momentum into the commercialization of scientific and technological achievements and intellectual property transactions.

Adopting data intellectual property licensing rights as the underlying trust assets, the innovative model establishes a multi-party collaboration platform through a trust structure, incorporating professional institutions specializing in legal services, asset appraisal, and achievement transformation. Beyond fulfilling fundamental functions such as protection of data IP rights and asset management, the model substantially boosts the commercialization and utilization efficiency of data IP assets and elevates their commercial value. Compared with traditional models, it eliminates concerns over the outright assignment of intellectual property rights and addresses the deficiency of diluted asset management inherent in pure income right assignment structures.

Acting as the legal intermediary and core architectural designer of this data IP trust project, Liu Shen & Associates drew on its profound long-standing expertise in intellectual property and data legal practices to jointly build the complete framework of this innovative model with CR Trust. During the project implementation phase, Liu Shen provided comprehensive legal support and assurance by verifying project feasibility, conducting legal due diligence, issuing legal opinions, and drafting and revising the full suite of transaction documents.
