Liu Shen Team Reverses Three Patent Reexamination Decisions in Administrative Litigation

Representing Takeda Pharmaceutical Company Limited, Liu Shen’s Biopharmaceutical Practice Group handled three administrative litigation cases concerning patent reexamination decisions and one patent reexamination petition case, all pertaining to patents within the same technical family. The team conducted in-depth analysis of the technical solutions and restructured the defense and litigation strategies, achieving remarkable outcomes. In the reexamination proceeding of the reexamination petition case, the team successfully persuaded the Patent Reexamination and Invalidation Examination Department of the China National Intellectual Property Administration (CNIPA) to revoke the original rejection decision, following which the relevant patent was promptly granted. In the other three administrative litigation cases involving patent reexamination decisions, the team also secured complete reversals. The Beijing Intellectual Property Court rendered administrative judgments to set aside the three unfavorable reexamination decisions against the client, all of which have taken legal effect. These achievements have provided robust patent protection for the client’s marketed products.
