Liu Shen Handled Case Selected among Tianjin Courts' 2025 Typical IP Cases
2026-06-11

A case of invention patent infringement represented by Liu Shen has been selected in the 2025 Typical Intellectual Property Cases released by the Tianjin Higher People's Court.

Both the plaintiff and defendant are globally renowned technology enterprises, and our firm acted for the defendant in the defense proceedings. Following thorough factual analysis, we mounted a comprehensive defense on behalf of our client, including non infringement (non falling within scope) defense, prior art defense, and legitimate source defense. Against the one sided appraisal report submitted by the plaintiff, our team raised well grounded challenges concerning the neutrality of the appraisal institution, scientific validity of testing methodologies, correctness of claim construction, and reasonableness of appraisal conclusions, prompting the court to conduct in depth hearings on these issues. Notably, given the case's representativeness and complexity, it was heard in open court as a model case. The Tianjin Higher People's Court invited several National People's Congress deputies, municipal People’s Congress deputies and members of the Chinese People's Political Consultative Conference to attend the hearing. With active judicial facilitation by the court, the parties reached an amicable settlement, and the plaintiff withdrew its complaint.

Through efficient collaboration with the client, the Liu Shen team delivered high quality work throughout the proceedings, demonstrating strong capabilities in handling complex patent infringement disputes.

The case was handled by ZHANG Xiang, XU Ruiqiao and SHI Teng.
